CRIMINAL LABOUR LAW

Health and safety in the workplace - Accidents - Occupational diseases - Exploitation of workers and the gangmaster system - Mobbing

The rules on hygiene, health and safety at work are binding for the business organisation. The prevention of accidents at work and occupational diseases is part of the broader issue of ensuring the health and well-being of employees.

The Firm’s professionals continuously deal with this matter in terms of organisational consultancy and adapting systems under Legislative Decree no. 231/2001, procedures, and risk assessment under the Consolidated Act Legislative Decree no. 81/2008. From a judicial perspective, the Firm deals with legal matters regarding Senior managers, executives and supervisors, as well as companies (for the Administrative Liability from crime) since they are often involved in trials for employee accidents and occupational diseases, in addition to the offences expressly provided for violations of the criminal code and Consolidated Act regulations. This includes assessing the civil liability consequences.

This matter comprises rules to safeguard the proper management of personnel, for which there has been increased interest in offences relating to illegal labour (the gangmaster system).
