BUSINESS CRIMINAL LAW – WHITE COLLAR CRIMES

With their consolidated experience, the Firm’s professionals assist companies and individuals in criminal matters, ensuring technical defence in Courts and Tribunals throughout Italy, including complex trials and preventive advice to exclude and minimise risks of offences and penalties.

Criminal risks lurk in business and professional activities. Business criminal law covers different management areas of the enterprises: financial and accounting management with corporate and tax offences, supplier and customer liability with public and private corruption offences. We have a focus on sustainability, which includes safety at work, environmental, town planning and public safety, and financial sustainability, including traditional bankruptcy offences and criminal tax law.

We deal with procedures relating to those offences dedicated to specific sectors (i.e., the financial, banking and construction sectors) and traditional criminal law cases that have found new vigour and application in the professional and financial field (negligent injury and manslaughter both in corporate and health sectors, including medical liability, offences against property such as contract management carried out using information technology).

Preventing corporate crimes is managed by daily advising corporate governance and management choices, and drafting Organisation and Management Systems (OMS), and the participation of professionals in the Supervisory Bodies (SB) of companies and entities governed by Legislative Decree no. 231/2001.

Studio Penco offers its professional experience to identify the areas, methods and defensive strategies in trials. The integration and synergy constantly enrich the consultancy provided by the Firm in these areas with multidisciplinary expertise through prestigious and consolidated partnerships. This guarantees the Client dedicated and complete services.
